Criminal Court

The criminal code of the state of Missouri is established by the Missouri General Assembly pursuant to the Constitution of Missouri. A variety of criminal prohibitions and penalties are created under Missouri law. 

Felonies are criminal cases for which the potential punishment is at least two years incarceration in the custody of the Missouri Department of Corrections. A felony case is initiated upon the filing of a Complaint on behalf of the State of Missouri by the Prosecuting Attorney of St. Charles County or by Indictment upon probable cause by a Grand Jury.

Misdemeanors are criminal cases for which the potential punishment is never more than one year incarceration in the custody of the St. Charles County Department of Corrections.  A misdemeanor is initiated upon the filing of an Information on behalf of the State of Missouri by the Prosecuting Attorney. 

In the Eleventh Judicial Circuit, felony cases are generally disposed of in Divisions 1, 2, 4, 5 and 7. Misdemeanor cases are disposed of in Divisions 9, 10, 11, 12, and 16. Cases are assigned randomly. The Chief criminal clerk is Megan Southern.

Division 10 is the treatment Court division pursuant to statute. Treatment Court provides personalized and intensive supervision and treatment of specific offenders. The Eleventh Circuit Treatment Court Administrator is Gina Colaneri.
